Terms & Conditions

1. Operator and Intermediary Marketplace Role

BigBigPlace.com (hereinafter referred to as "the Platform") operates strictly as an intermediary multi-vendor e-commerce marketplace and independent registration ticketing gateway. The Platform facilitates transactions by collecting payments on behalf of respective third-party service providers, tour operators, training academies, race event organizers, merchants, and product suppliers (collectively referred to as "Suppliers"). BigBigPlace.com is not the primary seller, creator, operator, or custodian of third-party goods, event logistics, or field experiences.

2. User Accounts, Eligibility, and Data Accuracy

  • Legal Age Capacity: By creating an account or completing a purchase on the Platform, you warrant that you are at least 18 years of age or are accessing the site under the active supervision of a parent or legal guardian.

  • Data Accuracy Obligations: You are solely responsible for ensuring the absolute structural accuracy of all registration files, shipping addresses, t-shirt size selections, and contact configurations. The Platform holds zero liability for delivery failures, custom tracking delays, or event registration rejections resulting from user data entry errors or typographical mistakes.

  • Account Security: You are entirely responsible for maintaining the confidentiality of your account credentials and password. Any actions taken using your logged-in profile shall be legally attributed to you.

3. Right to Modify Services and Refuse Service

  • Platform Modifications: BigBigPlace.com reserves the structural right to change, modify, suspend, update, or discontinue all or any part of our services, website infrastructure, e-commerce checkout loops, or partner registration gateways at any time, with or without prior notice.

  • Refusal of Service: The Platform reserves an absolute right to refuse service, block access, terminate user accounts, remove user-generated review content, or unilaterally cancel registrations, tickets, and product orders at our sole discretion.

  • Grounds for Action: This right may be exercised immediately and without liability if we suspect fraudulent payment behavior, payment chargeback threats, systematic terms abuse, malicious security manipulation, harassment toward our staff or Suppliers, or any form of digital system exploitation. Any orders canceled under this refusal-of-service provision due to suspected fraud or terms violations may be subjected to structural forfeiture of processing fees.

4. Payment Processing and Strict No Storage of Credit Card Information

  • Secure External Gateways: All financial transactions and digital payments processed on the Platform are executed through secure, PCI-DSS compliant third-party payment gateways and verified financial institutions.

  • Zero Data Retention: To guarantee maximum financial security, BigBigPlace.com does not collect, process, or store your credit card numbers, CVV codes, or sensitive banking credentials on our internal servers or databases.

  • Billing Identification: All transaction data is encrypted and passed directly to our payment partners. Your credit card statement or online banking ledger will display "BigBigPlace.com" as the billing merchant, indicating that the Platform has successfully processed your payment as an authorized collection agent on behalf of your chosen Supplier.

5. Marketplace API Sync and App Data Software Hold-Harmless

  • Automated Sync Tool Limitations: For automated marketplace transactions—including third-party merchants utilizing our dedicated integration app to sync orders to native Shopify or WooCommerce backends—the software is provided on an "as-is" basis.

  • Software Indemnity: BigBigPlace.com shall not be held liable or financially accountable to either the consumer or the vendor for any transaction dropouts, late order updates, web-hook delays, server sync drops, or digital notification failures originating from automated server architecture or API system maintenance loops.

6. Event Registration, Ticket Management, and Forfeiture

  • Bib Transfers and Disqualification: Race timing chips, bib numbers, event tickets, and credentials purchased through our gateway are personal to the registrant and strictly non-transferable unless explicitly authorized by the specific Event Organizer. Any unauthorized resale, swapping, or redistribution will result in immediate ticket cancellation without a refund.

  • Race Pack Forfeiture: Registrants are bound completely to the pack collection schedules defined by the Supplier. Any race packs, apparel elements, or participant kits not picked up within the announced periods will be deemed completely abandoned, and the Supplier or Platform reserves the full right to redistribute them without any form of compensation or credit reversal.

7. Sales and Service Tax (SST) and Levies

  • Tax Remittance: Certain underlying Suppliers are registered for Sales and Service Tax (SST) under Malaysian law. Where applicable, SST will be charged by the respective Supplier and displayed transparently at checkout.

  • Statutory Responsibility: BigBigPlace.com collects these tax amounts strictly on behalf of the registered Supplier and remits them directly to said Supplier. The Supplier holds sole statutory responsibility for declaring and remitting these taxes to the Royal Malaysian Customs Department.

8. Intellectual Property and External Links

  • Platform Assets: All content, graphics, layouts, brand logos, software, and proprietary code on BigBigPlace.com are the exclusive property of the Platform or its content suppliers and are protected by copyright and intellectual property laws.

  • Third-Party Redirection: The Platform contains links to external third-party websites or vendor portals. BigBigPlace.com does not endorse, control, monitor, or assume responsibility for the content, accuracy, or privacy practices of any third-party websites.

9. Platform Financial Liability Cap

  • "As-Is" Provision: The Platform is provided on an "as-is" and "as-available" basis. BigBigPlace.com does not warrant that checkout systems, API syncs, or database servers will be completely uninterrupted, timely, secure, virus-free, or error-free.

  • Liability Ceiling: To the maximum extent permitted by Malaysian law, BigBigPlace.com, its directors, and employees shall not be liable for any direct, indirect, incidental, or consequential losses, including lost data, financial fraud on external networks, or lost profits. The aggregate liability of BigBigPlace.com for any proven claims arising out of platform errors or systemic negligence shall be strictly limited to a cap of RM 100 or the equivalent platform processing fee paid by the user during that specific transaction (whichever is lower).

10. Force Majeure and Environmental Disruption

BigBigPlace.com and its respective Suppliers shall not be held liable for any cancellation, processing delay, or modification of bookings, event entries, and product shipments due to circumstances beyond reasonable control. This includes acts of God, natural disasters, extreme weather, government lockdowns, supply chain disruptions, customs delays, civil unrest, utility failures, or localized environmental hazards—such as the regional Air Pollutant Index (API) exceeding safe structural thresholds at an outdoor sports or race venue.

11. Governing Law

These Terms of Use and all user interactions on BigBigPlace.com shall be governed by, and construed in accordance with, the laws of Malaysia. Any legal actions, disputes, or claims arising from the use of this Platform shall be subject to the exclusive jurisdiction of the Malaysian courts.
